Yes, what has happened to the Public Trust Doctrine? In 1889 Washington State Legislature sold over 60% of our states tidelands to private citizens. Since then, Washington State's marine and shoreline protection is designated for the "public" 30% of tidelands not privately owned.

Here is a link to a legal review of the Public Trust Doctrine for public use of private tidelands. https://digital.law.washington.edu/dspace-law/bitstream/handle/1773.1/280/81washlrev813.pdf?sequence=1

We had asked the county to review this and set a policy. After several months the prosecuting Attorney Michael Haas sent an email out to us, department heads, County Commissioners, sheriff department and the various deputy prosecutors with the country's policy.

Basically the while there is some unsettled law if someone is below MHW, being respectful, not causing damage or taking shell fish it is not considered trespassing. So it is ok to go for walks on the beach or fish from shore.

If someone is harnessed while doing those activities by a property owner just call 911 and a deputy will come down and educate them.
